Update – County Attorney Considering Frenchtown Bartender Case [AUDIO]

Missoula County Attorney Fred Van Valkenburg says his office is looking over the case of the Frenchtown bartender who allegedly over-served a patrol who died later that nut in a drunk driving crash.

The body of 27 year-old Josh Carter was eventually found 10 days after he was seen leaving the tavern in Frenchtown. Carter had apparently driven off a steep ravine and his truck landed upside down in an irrigation ditch. Johnson says Carter’s blood alcohol level was more than twice the legal limit of 0.08%.

Van Valkenburg says the bartender could be charged with a misdemeanor for serving alcohol to an intoxicated person. He also said in a case like this, the Montana Revenue Department’s Liquor Control Board would closely examine the license owned by the tavern itself, whether or not the server was found guilty.

He says the Montana Tavern Owners Association and other organizations work hard to ensure their servers are trained not to over serve their patrons.
